Abstract

With the inauguration of a second Trump administration, concerns are growing over the possible intensification of U.S. trade policy, particularly regarding the expanded use of countervailing duties (CVDs). Given the U.S. government’s active enforcement of subsidy disciplines in recent years, there is increasing apprehension that investigations targeting Korea may be broadened. Against this backdrop, the U.S. Court of International Trade (CIT) has reviewed several cases concerning Korea’s Emissions Trading Scheme (K-ETS), with the U.S. Department of Commerce having conducted legal analyses on whether the free allocation of emissions allowances constitutes a countervailable subsidy. This paper examines the legal issues and challenges identified during the CVD investigations and determinations concerning the free allocation of emissions allowances under K-ETS. In particular, it analyzes how the U.S. legal framework on “specificity” was interpreted and applied in the exchange between the Department of Commerce and the CIT—an area where legal scholarship remains limited. The paper further investigates why investigations into hot-rolled and cut-to-length steel products, which shared similar factual circumstances, led to inconsistent outcomes. It is argued that the inherent limitations of allocation criteria—designed with the intent to prevent carbon leakage—along with the interplay between de jure and de facto specificity, make it difficult to avoid a finding of specificity once the subsidy element is established. The analysis concludes that, given the nature of subsidy regulations, which aim to prevent market distortions and economic harm across industries, a purely legalistic approach is insufficient in addressing the challenges posed by U.S. CVD measures. Instead, the paper suggests that a viable path forward may lie in seeking political solutions among states, as legal defenses alone are unlikely to provide effective remedies.
