정부는 지난 4월, 2015년부터 국내에 온실가스 배출권거래제 도입을 골자로 하는 「온실가스 배출권의 할당 및 거래에 관한 법률안」을 마련하여 국회에 제출하였고, 국내적으로 이러한 배출권거래제 도입과 관련된 다양한 법적 쟁점들에 대해 활발하게 논의가 진행 중에 있다. 이러한 규제정책은 현재의 글로벌 통상환경에서 상품 및 서비스의 국제교역에 여러 경로를 통해 영향을 미치게 되며, 이로 인해 무역자유화를 규정한 WTO 협정과 관련된 다양한 이슈들이 제기된다. 그 중에서도 본고는 국내 사업자에게 탄소배출권을 무상으로 할당하거나 국내 사업자가 생산하는 제품이 외국으로 수출될 때 탄소배출권 확보 의무를 면제 또는 경감해 주는 조치가 WTO 보조금협정상 의무를 위반하는 것인지, 협정 위반이라면 이를 정당화할 예외조항이 있는지의 두 가지 핵심 질문에 대해 중점적으로 분석하였다. 본고 분석의 시사점은 다음과 같다. 우선, 이론적 측면에서 탄소배출권의 무상할당은 그 자체로는 WTO 보조금협정 위반으로 볼 여지가 크지 않다. 설령 보조금의 요건을 충족한다고 하더라도, 수출과 결부되어 부과되는 것이 아니므로 금지보조금이라고 볼 수 없으며, 특정성이 존재하지 않으므로 조치가능 보조금에도 해당되지 않는다. 그러나, 현실적 측면에서 탄소배출권 무상할당을 운영하는 방식에 따라 WTO 보조금협정 위반 문제가 제기될 가능성은 여전히 남아 있다는 점을 유의해야 한다. 사업자에게 과거실적에 따라 탄소배출권을 할당함으로써 당해 연도 실제 배출치에 비해 과대계상될 가능성이 있으며, 이러한 경우에는 보조금협정 위반이 될 소지가 있다. 또한, 정부가 탄소배출권의 무상할당을 향후 단계적으로 유상할당으로 전환해 나가는 과정에 있어, 탄소배출권 무상할당이 특정 수출산업이나 기업에만 집중될 경우 보조금협정상 금지보조금 또는 조치가능보조금에 해당될 여지가 크다. 경쟁력 및 탄소누출 우려 해소방안으로 제기되는 수출상품에 대한 탄소배출권 리베이트의 경우에도 수출과 결부되어 지원되는 조치이므로 보조금협정상 금지되는 수출보조금으로 판단될 여지가 크다. 다만, 구체적으로 어떤 조치가 보조금협정 위반이 되는지에 대해서는 보다 많은 연구와 논의가 필요하다.
Abstract
Last April, the Korean government has announced to introduce emission trading system from January 1 of 2015, which stretched the timetable for its introduction out further two years and increased percentage of free carbon allowances in response to strong opposition from domestic industries. Under the system, yet to be approved by the Assembly, the percentage for free allowances is over 95 percent and the rest will be put to an auction. The system is part of its efforts to attain legitimate environmental goal to reduce greenhouse gas emissions by 30 percent from BAU level by 2020. In this globalized trade environment, however, such a market intervention by the government, even though non-trade measure, would inevitably affect trades with other countries, raising several issues of WTO legitimacy. Among others, this study focuses on issues related to the legality of free carbon emission allowance under the law of WTO Agreement on Subsidies and Countervailing Measures (SCM Agreement). The proposed conclusions of this study are as follow. First, in the theoratical aspect, the free allowance alone seems not to be inconsistent with the SCM Agreement because the specificity will not be found. On the other hand, in the practical aspect, there are a number of issues to be considered. For instance, under the grandfathering method of allocation, the problem of over-allowance of carbon emission rights may arise. Also, once the government tries to change the scheme into the allocation by auction gradually, the risk of WTO inconsistency would increase. The international community must look into the issue more carefully and discuss all the possible solutions.
