Abstract
In recent years, as a response to climate change, practically all countries have adopted carbon neutrality as a common goal and responsibility. Various climate change response policies have been introduced worldwide, and most often, transition to clean energy industries is sought through the form of public expenditure since substantial amounts of investments are required to develop clean energy technologies and establish related industrial infrastructures. As major countries, such as the U.S. and the EU, are increasingly competing in providing support for clean energy transition, it has been pointed out that such governments’ support to domestic industries may be contrary to the WTO Subsidies Agreement because it affects conditions of competition in international trade. In particular, the additional free allocation of emission permits under the Korean emission trading system as part of Korea’s fulfillment of obligations under the Paris Agreement was determined as a countervailable subsidies under the U.S. law, resulting in an unfavorable situation for the Korean companies. However, this is likely to conflict with the fact that the international community is making every effort to address climate change as a global common goal. Accordingly, this paper examines the purpose and operating methods of the Korean emission trading system, the logic behind the U.S.’ determination that the additional free allocation of emission permits amounts to countervailable subsides, and how clean energy subsidies aimed at responding to climate change can be compatible with the WTO Subsidies Agreement. Taking into account the operating methods of the Korean emissions trading system and the legal nature of emission permits, this paper assesses that the U.S.’ determination, which concluded the entire additional free allocation of emission permits as a countervailable subsidy, is highly likely to contradict the legal principles and related judgments under the WTO Subsidies Agreement. However, apart from such legal discussions, under the current situation where the free allocation of additional emission permits to a certain range of industries is determined as countervailable subsidies, it is necessary to seek ways to avoid conflicts between the Subsidies Agreement and international environmental obligations, and to pursue a harmonious balance. This paper does not consider that clean energy subsidies create an inevitable conflict of norms between the fulfillment of obligations under the Subsidies Agreement and the Paris Agreement. In particular, the additional free allocation of emission permits implemented under the Korean emission trading system should not be interpreted as meeting the financial contributions requirement under the Subsidies Agreement. Moreover, in the case of clean energy subsidies in general, by interpreting the Subsidies Agreement and multilateral environmental agreements according to the principle of harmonization, the obligation to reduce greenhouse gas emissions under the Paris Agreement and the resulting financial burden should be regarded as a comprehensive and single obligation to reduce greenhouse gas emissions, when considering the cost borne by the beneficiary companies to reduce greenhouse gas emissions while assessing the benefits requirement under the Subsidies Agreement. Lastly, in addition to seeking harmonious interpretation of these treaties, it is ultimately necessary to solve the subsidy issues for the transition to clean energy industries through mutual agreements among countries based on a global common understanding of climate change response.
