Abstract

are more than 1,000 denial of service attacks every 24 hours, 50,000 fhishing attacks (or identity theft) every month and thousands of cases of online child abuse. The recent cyber crime seems to be significantly influenced by rapid augmentation of cyber-crimes (computer-based crimes on the Web). That is to say, the cyber crime is a significant threat to the economic and social well-being of our countries and our citizens, and as online criminals operate across national borders. There are two reasons why cyber crimes are speedily able to be involved with deviant acts in cyber-space. First, swiftly adapting to the latest technology of the information era, they acquire the ability to access and use internet. Second, people usually deal with various kinds of information floating on the Web without contemplation based on sound value system, and therefore their response may be impulsive and extemporaneous. The Council of Europe’s work in this area builds on its 2001 Budapest Convention on Cybercrime, which is the only accepted international treaty on how to protect people and their rights against online crime. As a result, cooperation between parties to the convention – as well as investigations and prosecutions in countries that have brought their laws in line with the treaty – have increased. The Budapest Convention is the international community’s most forceful common response to date. It serves as a breeding ground for international partnerships and has the interests of you and me in mind: to protect our rights in cyberspace. Therefore South Korea also should participate in the Budapest Treaty as soon as possible.
