복잡한 소비패턴 속에서 소비자 관련 분쟁이 점점 많아 지고 있으나, 이에 대한 보호법제는 아직고 정비가 되어 있지 않아. 이에 소비자법학과 관련된 학계의 연구는 향후 발전방향 등을 제시해줄 수 있다는 점에서 중요한 의미를 가진다고 할 수 있다. 이에 본고는 “2016년 소비자법 연구의 동향”을 정리 소개하고 있다. 이 글이 지난 해의 연구동향을 조감하는데 도움이 되길 기대하며, 앞으로의 연구방향을 가늠할 수 있는 자료가 되기를 기대해 본다. 본고에서는 먼저 2016년에 있었던 소비자법에 관한 주요 학술대회를 개관하고(Ⅱ), 이어서 소비자법의 주요 분야별로 어떤 연구들이 진행되었는지를 알아보았다(III). 그 주요 분야로는 그 주요 분야로는 약관(Ⅲ. 1), 책임법리에 의한 소비자보호Ⅲ. 2), 금융소비자보호(Ⅲ. 3), 개인정보보호(Ⅲ. 4), 고령소비자보호(Ⅲ. 5), 집단소비자 피해구제 및 단체소송(Ⅲ. 6), 소비자철회권 등에 의한 소비자보호(Ⅲ. 7)로 분류하였으며, 유형을 분류하기 어려운 연구주제는 기타(Ⅲ. 8)로 분류하였다. 마지막으로 2017년 소비자사법 연구의 전망(IV)을 언급하였다.
Abstract
Consumer disputes continue to arise in modern society. By the way, in the absence of the Consumer Protection Act, academic research on this issue is important in that it can provide directions for the future. For this purpose, this article organizes the trend of consumer law research in 2016. First, I provide a general review of the major consumer law symposia held in 2016 (Ⅱ), then examine the research taking place in each major field of consumer law. I classify these fields thusly; Standard terms of contract (Ⅲ. 1), Consumer protection by liability law(Ⅲ. 2), Financial Consumer Protection(Ⅲ. 3), Personal Information Protection(Ⅲ. 4), Elderly Consumers Protection(Ⅲ. 5), Class Action(Ⅲ. 6), Consumer Protection through Consumer Withdrawal Rights(Ⅲ. 7), and Miscellaneous(Ⅲ. 8). Finally I discuss the outlook of consumer law research in 2017 (IV). I hope that more research will be done in the future with reference to this article.
