내·외국인의 차별경험이 폭력태도에 미치는 영향 : 법 인식수준으로 조절된 부정적 정서의 매개효과를 중심으로

초록

본 연구의 목적은 일반긴장이론을 기반으로 내·외국인 집단별 차별경험이 부정적 정서를 통해 폭력태도에 미치는 영향이 법 인식수준에 의해 조절되는지를 검증하는 것이다. 이를 위해 한국형사정책연구원의 ‘외국인 폭력범죄에 관한 연구’ 설문자료를 사용하였고, Process Macro model 4와 14를 활용하여 매개효과와 조절된 매개효과를 분석하였다. 분석결과 내국인과 외국인 집단 모두 차별경험이 폭력태도에 미치는 영향에서 부정적 정서의 매개효과는 유의한 것으로 나타났다. 다음으로 내국인 집단에서 법 인식수준은 차별경험이 부정적 정서를 통해 폭력태도에 미치는 매개효과를 조절하지 않는 것으로 나타난 반면, 외국인 집단에서는 법 인식수준이 위 매개효과를 조절하는 것으로 나타났다. 즉, 법 인식이 높은 외국인의 경우, 차별경험으로 인해 부정적 정서가 높아지더라도 폭력태도로 이어지지 않는 반면, 법 인식이 낮은 외국인의 경우, 차별경험으로 인해 높아진 부정적 정서가 폭력태도로 이어지는 것으로 나타났다. 이러한 분석결과는 적어도 외국인의 경우, 차별경험으로 인해 높아진 부정적 정서가 폭력태도로 이어지지 않도록 하기 위해 법 인식수준을 제고할 필요성이 있음을 시사한다. 또한, 내국인의 경우, 법 인식 수준을 통한 간접적인 접근보다는, 차별경험과 부정적 정서 자체에 대한 개입이 필요함을 시사한다.

Abstract

The purpose of this study is to examine whether the effects of discriminatory experiences on violent attitudes, mediated by negative emotions, are moderated by the level of legal awareness among natives and foreigners, based on General Strain Theory. For this, survey data from the Korean Institute of Criminology and Justice’s study, ‘The study on violent crimes by foreigners’ was used, to analyze mediation and moderated mediation effects with Process Macro Model 4 and 14. The analysis results indicate that, for both native and foreign groups, negative emotions significantly mediate the effect of discriminatory experiences on violent attitudes. Furthermore, among natives, legal awareness did not moderate the mediating effect of negative emotions on the relationship between discriminatory experiences and violent attitudes. However, among foreigners, legal awareness did moderate this effect. Specifically, for foreigners with high legal awareness, increased negative emotions resulting from discriminatory experiences did not lead to violent attitudes, whereas for those with low legal awareness, increased negative emotions resulting from discrimination did lead to violent attitudes. These findings suggest the need to enhance legal awareness, at least among foreigners, to prevent the progression from increased negative emotions due to discriminatory experiences to violent attitudes. For natives, the results imply that direct interventions targeting discriminatory experiences and negative emotions may be more effective than indirect approaches via legal awareness.
