Abstract

This study examines the procedural significance and limitations of criminal legislation by analyzing the legislative process of the “Nth Room Prevention Act.” The legislative dynamics were explored through in-depth interviews with 12 stakeholders who directly or indirectly participated in the lawmaking process. The Act reflects the unique characteristics of digital sexual crimes by introducing new criminal provisions and increasing statutory penalties. In particular, the legislation gained procedural legitimacy through the National Assembly’s citizen petition system, representing a citizen-driven legislative initiative. Furthermore, it laid the foundation for establishing governance structures to regulate emerging digital threats, such as anonymity-based online offenses. However, the absence of a proportion- ality review in legislative deliberations limited consideration of comple- mentary social policy measures beyond punitive sanctions. This analysis offers insights into the future procedural orientation of criminal legislation in response to digital sexual violence.
