미국 로스쿨과 학부 정치학 관련 전공과의 연계성 검토

정치학 관련 전공은 법학전문대학원에 진학을 희망하는 학생들에게 유익한 기초교양 교육을 강화할 수 있도록 정치학 교과과정 제공에 배가된 노력이 요구된다. 이 연구는 미국사례 분석결과를 교훈삼아 한국에서 법학전문대학원 도입을 계기로 정치학 관련 전공의 커리큘럼 개발에 참고할 사항을 몇 가지 제안한다. 정치학 성격 자체가 기초학문에 속하기 때문에 미국 대학 학부에서 정치학을 전공한 졸업생들의 진로는 매우 다양하다. 그 중에서도 학부에서 정치학을 전공한 사람들이 로스쿨에 진학하고자 하는 선호도는 중요한 선택 대안 중의 하나임에 틀림없다. 이런 현실을 고려해서 미국의 각 대학 정치학 관련 학과는 학과차원에서 로스쿨 지원자를 위한 프로그램을 운영하고 있다. 그 프로그램이 대학마다 혹은 학과마다 모두 같은 것은 아니다. 소위 명문사학 정치학과는 정치학 기초교육에 보다 많은 비중을 두고 있기 때문에 정치학 전공자들에게 로스쿨 지원을 위한 별도의 프로그램은 운영하지 않는 것이 보통이다. 이에 비해 명문 주립대학을 비롯한 많은 사학에서는 대체로 로스쿨 지원자를 위한 여러 프로그램을 운영하고 있다. 대학마다 차이가 있기는 하지만 그 프로그램은 로스쿨 지원자를 위한 상담체제 운영, 로스쿨과 학부 정치학 전공의 협동과정 운영, 그리고 로스쿨 지원자를 위한 과목 개설 등으로 요약된다. 한국에서 법학전문대학원 도입을 계기로 정치학 기초영역을 강화시키는 방향으로 교과과정 개선이 필요하다. 정치학 관련 학과를 전공을 하는 학생들이 정치학의 주요 과목을 단계적으로 배울 수 있도록 적절하게 단계(stages)별 그리고 영역(issues)별로 재배치하여 군집화(clustering)하는 일도 필요하다.
Abstract
The professional law school system was adopted and executed in Korea in March 2009. The adoption of the law school system will make a great impact on the educational environments in Korean colleges and majors. In particular, the educational conditions at the undergraduate level will be changed a great deal. With English literature and history major, political science is one of major majors which provide more excellent students to law schools than any other majors in the United States. At the department level, many American political science departments run special programs for undergraduate applicants for law schools. Most political departments have on-and-off line advisory system for the applicants. Specialists as well as faculty members are employed for advising the applicants. Some political science departments, with a cooperation with their law school faculties, run a joint program for both M.A./J.D. degrees. It is noticeable that some political science departments provides undergraduate students with specially designed courses such as Politics and Law, Constitutional Law, and Civil Liberties. The adoption of professional law school in Korea gives political science communities a chance to evaluate the present curriculum and to create a constructive program.
