과학의 발전과 새로운 의료기술의 발전으로 인해 이전에 치료법이 알려져 있지 않은 만성질환-즉 고혈압, 당뇨, 암 등을 지닌 환자에게 의학적인 치료가 가능하게 되어 삶의 질을 높이고 생명을연장하게 되었다. 의료진은 심각한 질환에 알맞은 치료를 제공해야 한다. 또한 의료진은 환자의 원하는 점을 파악하고 이에 알맞고 가장 환자에게 알맞은 의료적 돌봄을 제공해야 한다. 사전의료의향서는 말기환자에 대한 돌봄을 결정하는데 의학적 윤리뿐만 아니라 법적인 요구를 감안하고 있다. 의료진은 심폐소생술, 수혈, 인공호흡기와 경구 혹은 정주의 영양 공급과 같은 연명치료와 관련되어결정하기 위해서 환자와 그 가족들과의 대화기법과 지식을 충분하게 지녀야 한다. 또한 의료진은환자에게 시행되는 의료행위는 정부에서 정한 법의 테두리 안에서 환자의 돌봄의 계획에 대하여 책임을 져야 한다. 말기환자의 치료에 대하여 광범위한 법적인 동의가 있으나 아직 우리나라에서는사전의료의향서에 대한 법률이 제정되어 있지 않다. 말기 환자를 돌보는 의료진에게는 이러한 윤리적, 법적인 이해를 하는 것이 중요하며, 본인들이 시행한 의료행위는 법에 의해 보호받아야 한다. 그러므로 말기환자에 대한 사전의료의향서를 허용하기 위하여 법적인 뒷받침이 있어야 하며 구체적인 내용과 방식에 대한 합의가 정부와 전문가의 노력이 함께 필요할 것이다.
Abstract
Because new science and technology have offered the potential of medical therapies previously unknown, people with chronic diseases, which are hypertension, diabetes mellitus, and cancer,have good living and prolong life. Physicians should provide comfort in the front of serious illness. Also, they are responsible for offering that the patient's wishes and are documented and supported by the appropriate medical orders. Advance directives (AD) is not only medical ethical but also legal requirement in end of life care decisions and may be in placed and helpful. It is critical that physicians have the knowledge and skills necessary for communication of decisions related to life-sustaining treatment including cardiopulmonary resuscitation, transfusion, artificial ventilator,and nutrient supply including intravenous or oral uptake. Also, they have a responsibility to make ethical decisions in the care of patients within the law that governs their medical practice. Although there is broad legal consensus on much of end of life treatment, there is not law for AD in Korea. It is important for physicians who take care for patients with terminal diseases to understanding the ethics and legal consensus. The effort of expert for terminal care and concerned AD and a governmental organization is necessary to make law to allow AD.
