Abstract
The conclusion of multilateral treaties and participation in international conferences are crucial from the standpoint of state recognition. This is because participation in international conferences means that it has been approved by the international community as an independent state. Participation in the Hague Peace Conference, which was held twice as the beginning of the League of Nations, the forerunner of the United Nations, today's representative international organization, needs to be examined more closely in that it is possible to confirm whether the Korean Empire approves the state, not just on the issue of special envoys. Since the Korean Empire was an independent state with no problems when the first Hague Peace Conference was held in 1899, it was able to subsequently join the convention in 1903. It also joined the Geneva Convention. Russia invited the Korean Empire to the Second Hague Peace Conference in April 1906, even after the signing of the Japan-Korea Treaty of 1905 in November 1905. The Korean Empire attempted to participate in the Second Hague Peace Conference in 1907. However, because the situation in which Korea's diplomatic right was transferred to Japan due to Japan-Korea Treaty of 1905 was shared among the powers, participation in the conference was not recognized. However, not all states that participated in the Second Hague Peace Conference were independent. The Principality of Bulgaria among the conference participants was under the suzerainty of the Ottoman Turks until the declaration of the kingdom in 1908. Cuba was a Protected State of the United States, which, shortly after gaining independence with the help of the United States in 1902, was disenfranchised from signing the Cuban–American Treaty of Relations and recognized US involvement. All of them were semi-sovereign states, but they had the right to engage. As a result, the Korean Empire, which had the military and the Right of Belligerency, was also entitled to participate in the Hague Convention, which was part of the International Law of War. The fact that the Korean Empire was a Protected State that handed over diplomatic right to Japan did not necessarily mean that it was ineligible to participate in the Second Hague Peace Conference.
