Abstract

Open Source has a chance to bloom through Android platform in the mobile smart environment, though its popularity starts from LINUX. Open source resulted from “Copyleft” idea, but ironically it has also a copyright-based licensing system for secure its community stability. It formally allows modification and distribution on conditions such as source code availability, royalty free use and other requirements. This license is viral, or infectious, and it has sometimes a strong scope for modifications or derivative works. The compass of a strong viral license would apply itself to software coupled with closed source. With this feature this article explores the benefit and cost of viral provisions in these licenses and assesses the efficacy of broad viral license terms to determine incentive effects for open source and closed source software. Under the intense scrutinization under the competition law, the its enforcement would be considered. As a result, open source licensing should be define viral terms to a minimum in order to support open source development without countervailing effects and misaligned incentives.
