공연음란범죄의 실태와 특성에 관한 연구: 형사판결문 분석을 중심으로
An Examination of the Nature and Characteristics of Indecent Exposure Crimes: Focusing on the Analysis of Criminal Judgments

공연음란범죄는 공개된 장소에서 음란한 행위를 함으로써 타인에게 불쾌감이나 성적 수치심을 유발하는 행위로, 사회적 불안을 조성하고 공공의 안전을 저해한다. 본 연구는 최근 2년간(2022년~2023년) 공연음란범죄 형사판결문 523건을 수집하여 실태와 특성을 분석하였다. 그 결과 공연음란범죄는 주로 여름 오후부터 자정 사이에 건물 안, 노상, 대중교통수단 등의 장소에서 범행 전 일면식이 없는 관계에서 빈번하게 발생하는 것으로 확인되었다. 군집 분석으로 공연음란 범죄자 유형을 분류한 결과 정신질환 이력이 없고 술에 취하지 않은 범죄자가 일면식 없는 피해자를 상대로 자위행위를 하는 “비면식관계 중심의 성적일탈군”과 정신질환 이력이 있거나 음주를 한 상태인 범죄자가 지인을 상대로 성기노출 행위를 하는 “정신질환·음주 상태의 단순노출군”으로 구분되었다. 연관규칙분석을 수행한 결과 일부 공연음란 범죄자는 강제추행, 성폭력처벌법위반과 같은 심각한 성범죄 전과가 있어 정책적 관리 필요성이 높은 것으로 나타났다. 마지막으로 공연음란범죄의 예방과 수사 활동을 위한 제언과 연구의 한계점을 논의하였다.
Abstract
Indecent exposure crimes causing discomfort or sexual shame through obscene acts in public pose significant social concerns. This study examines the nature and characteristics of indecent exposure crimes by analyzing 523 criminal judgments from the past two years (2022-2023). Findings indicate that such crimes predominantly occur during summer, between early afternoon and midnight, in locations such as buildings, streets, and public transportation systems. Additionally, it was found that the offenders and victims were often complete strangers. Through cluster analysis, offenders were categorized into two distinct groups: the "Sexual Deviant Group," characterized by individuals without mental illness or intoxication, who engage in masturbation targeting complete strangers; and the "Simple Exposure Group," comprising offenders with a history of mental illness or intoxication, who expose themselves to acquaintances. Association rule analysis revealed that certain indecent exposure offenders are at elevated risk due to previous serious sexual offenses. The study concludes with a discussion on policy implications for preventing indecent exposure crimes and acknowledges its limitations.
