Abstract
This article is a new legal figure on “regulated self-regulation” in neoliberal privatization. Regulated self-regulation has its origins in environmental and media law. In addition, it is used, for example, in product safety law for product certification and in commercial law in the form of controlling the accounting. Regulated self-regulation is the combination of imperative regulation and social self-regulation. Under imperative regulation is the sovereign external regulation by the state to understand. The concept of “regulated self-regulation” is changing the role of the state away from hierarchical control towards the modulation of social processes. If the state now only ensures that this task is performed by private individuals in areas in which it formerly took over the provision of public services, the term “guarantee state” is used. In the state of guarantee, administrations and social actors are pursuing strategic goals in ever closer cooperation networks. Regulated self-regulation is not about law-enforced social governance but about a specific governmental control strategy. Unlike in Germany, self - regulation in Korea has caused problems in the local public enterprises act and the local government law. From 2003 onward, the public transportation settlement work has been entrusted to the contractor in the form of self-regulation of the project owner through contracts. Despite the clear nature of the public transportation business, the public transportation card business is being promoted as a private business due to lack of budget, so that the controversy over privatization, securing of publicity and regulated self-regulation remains. In the former local public enterprises act, the 'third sector', which is a type of corporation in which local governments invest less than 50%, was also classified as being included in local public enterprises. Therefore, in Article 77-3 of the former local public enterprises act, it was a matter of whether ‘Provided free of charge’ was included in the meaning of ‘Investment’. At present, however, this provision is removed and is not a problem. In accordance with Article 41 of the Local Government law and Article 42 of the it’s Enforcement Decree, the company is audited by local council, if more than 25% of the total capital amount is invested by a local government or affiliated public corporation. The privatization and self-regulation of the public transportation business have resulted in the power and conflicts of the local councils. There has been a case of requesting a penalty charge to KSCC, which refused to be audited by local council, despite the legal interpretation of the Ministry of Government Legislation. However, there is a problem that the interpretation of the MOLEG does not conform to the definition of Contribution and Investment described above. In conclusion, regulated self-regulation not only compensates for the weaknesses of the regulatory regime, but also suggests that it is possible to strategically transform the national control in the privatized area. As can be seen from the case of the public transportation settlement business, it is difficult to find a solution to the extent to which local governments are responsible for ensuring the publicity of the private-sector business and how to meet them. In this meaning, a comparative analysis of regulated self-regulation, using the example of the Public Transport Fare System in Seoul and KSCC (Korea Smart Card Co., Ltd.), is considered to be systematic analysis.
