프랑스의 인간대상(인체유래물) 연구에 관한 소고

오늘날 생명과학에 관한 탐구가 비약적인 발전을 거듭하면서 의료행위의 패러다임 변화가 요구되고 있다. 이와 관련하여 프랑스는 1994년 생명윤리와 관련된 법률을 제정하고, 2004년 생명윤리법을 탄생시켰으며, 2009년 인간 연구에 관한 법률안(Proposition de loi relative aux recherches sur la personne)과 2012년에 인간을 대상으로 한 연구에 관한 2012년 3월 5일 제2012-300호 법률(LOI n° 2012-300 du 5 mars 2012 relative aux recherches impliquant la personne humaine)을 제정하였다. 이와 같이 프랑스는 ‘인간에 대한 연구’의 연구능력을 강화하고자 하였다. 이와 같이 프랑스에서는 생명윤리법의 제정 및 개정된 내용들이 공중보건법에 편입되면서 인체유래물연구에 있어서의 동의와 동의면제와 관련된 제도들이 전개되어 왔다. 특히 프랑스의 인체유래물연구는 우리나라의 인간대상연구와 맥락을 같이 하고 있다. 그러나 국내에 프랑스의 인간대상연구에 관한 상세한 소개가 미흡한 상황이다. 본 연구의 목적은 프랑스의 인간대상연구에 대한 개념과 허용범위 및 규제기관 그리고 동의와 동의면제제도 전반에 관한 고찰을 통하여 인체유래물연구제도를 연구하고 있는 연구자들에게 중요한 자료를 제공하고자 하였다. 따라서 본 논문은 프랑스의 인간 대상 연구에 관한 기본법인 생명윤리법의 전개과정을 일별하고(Ⅱ), 인간대상연구의 개념과 3가지 범주 등 허용범위에 대해 알아보고(Ⅲ), 계속해서 인간대상연구 규제기관(Ⅳ)과 인간 대상 연구의 동의 및 동의 면제제도(Ⅴ)에 관해 법률조항을 중심으로 살펴보고 정리하고자 한다.
Abstract
Today, as research on life sciences is making great strides, a paradigm shift in medical practice is required. In this regard, France enacted a law related to bioethics in 1994, created the Bioethics Act in 2004, enacted the Law on Human Research (Proposition de loi relative aux recherches sur la personne) in 2009, and enacted the Law No. 2012-300 of March 5, 2012 on research involving humans (LOI n° 2012-300 du 5 mars 2012 relative aux recherches impliquant la personne humaine) in 2012. In this way, France sought to strengthen its research capacity for ‘research on humans.’ In this way, as the enactment and revision of the Bioethics Act were incorporated into the Public Health Act, systems related to consent and exemption of consent in research on human-derived materials were developed in France. In particular, human subject research in France is in line with human subject research in Korea. However, there is a lack of detailed introduction to human subject research in France in Korea. The purpose of this study is to provide important data to researchers studying the human subject research system by examining the concept, scope, regulatory agency, and consent and exemption system of human subject research in France. Therefore, this paper will examine the development process of the Bioethics Act, the basic law on human subject research in France (Ⅱ), examine the concept of human subject research and the scope of permission including three categories (Ⅲ), and then continue to examine and organize the regulatory agency for human subject research (Ⅳ) and the consent and exemption system of human subject research (Ⅴ) focusing on legal provisions.
