Abstract
This study was initiated from the question of whether the principle of informed consent that sets the requirement to obtain informed consent from human subjects before starting research involving them and the exemption of written consent from such a requirement, in the provisions of the Article 16 'Consent of the Research Subjects' of the Bioethics Act, is appropriate. For this purpose, the provisions on exemptions from written consent in domestic laws, international conventions, and U.S. Department of Health and Human Services (DHHS) regulations were reviewed. While the standardization of approaches to protection of human subjects in research involving them according to the research purpose is difficult, the legal provisions on consent in such research should be improved to increase the acceptability of the norms. To do so, the following suggestions are made. First, relevant provisions in the Bioethics Act should be improved by making clear distinction between 'consent' as a means of obtaining such consent and 'written consent' as a means of records, and between 'exemption from consent' and 'exemption from written consent'. Second, with respect to the means of "consent," while the definition of "written consent" is limited to means of recording, there should be criteria that allow for a wide range of forms of consent depending on the nature of research. Third, the unclear criteria and scope of exemptions from the requirement of written consent should be clarified. In addition, it appears that exceptions are necessary as the scope of personal sensitive information is excluded as a requirement for exemption from written consent. In other words, although the principle is to obtain 'consent', it is necessary to respect the will of the research subjects, just as in international norms and foreign cases, in deciding whether to record 'consent' in the form of 'written consent'.
