Abstract

Since the comprehensive revision of the Bioethics and Safety Act (hereinafter referred to as “the Bioethics Act”) in 2012, the definition clause for human subject research and the regulations on exemption from review have remained unchanged. In this paper, I review six types of research and point out the need to revise the definition clause and exemption provisions, arguing as follows. First, the term “private” should be added, and research utilizing identifiable ‘private’ information should be defined as human subject research. Second, research collecting and utilizing information “about a research subject” should be defined as human subject research. Therefore, collecting information “from a person,” such as expert advice or surveys on policies, is not human subject research. Third, even survey research that collects information about research subjects should be defined as “research exempt from review” under the Bioethics Act if it meets the criteria for exemption from application of regulations in 45CFR46 (“Common Rule”) of the US. The Bioethics Act stipulates that, in the case of survey research, even studies that do not collect or record personally identifiable information are not exempt from review if they collect sensitive information such as health information, while studies that do not collect or record personally identifiable information and utilize existing data or documents may be exempt from review even if they include sensitive information such as health information. This creates inconsistency. It is necessary to overcome this inconsistency and introduce more reasonable criteria for review exemptions. Fourth, the procedures for confirming review exemptions must be substantively distinct from review procedures, whether they are expedited reviews or formal reviews. This paper presents proposed amendments to the definition of human subject research and the review exemption provisions, hoping that the above arguments will be reflected in the revision of the Bioethics Act.
