개인의 자유와 권리를 강조하는 자유주의적 분배정의는 개인의 사유재산권을 옹호하고, 시장제도에 영향을 미치는 강자의 이익을 대변하고 있다고 볼 수 있다. 분배제도의 개선과 공공정책의 수립에 막대한 영향력을 행사해 온 공리주의적 분배정의는 ‘최대다수의 최대행복’이라는 기준을 제시함으로써 사회질서에 따라 다르게 나타날 수 있는 분배정의의 임의성을 어느 정도 개선시켰다. 그러나 공리주의적 분배정의는 가치판단을 분석대상에서 제외시키는 오류를 범했으며, 분배정의의 척도인 개인의 행복의 합산이 어렵다는 기본적인 문제를 안고 있다. 받을만한 자격을 강조하는 평등주의적 분배정의는 사회구성원들의 후생의 합을 극대화하기 보다는, 사회에서 가장 불우한 사람의 후생수준을 개선시키는 것이 바람직하다는 객관적인 분배기준을 제시한다. 그러나 자유라는 도덕적 가치와 권리를 경시할 수 있다는 한계가 있다. 이러한 다양한 분배정의의 장단점을 취사선택하여 한국사회의 분배문제를 해결할 수 있는 절충적인 분배정의의 요소들로 경제활동에 있어서의 동등한 출발, 공정한 경쟁, 최저수준보장 등을 들 수 있다.
Abstract
Libertarian distributive justice, emphasizing the liberty and right of each individual, advocated the private ownership and the interests of the strong affecting the market institution. Utilitarian distributive justice, by suggesting 'the greatest happiness of the greatest majority' as the criterion of distributive justice, improved the voluntariness of distributive justice regulated by the distinctive social order. But it eliminated the value judgement in distribution and had the defect of summing up the subjective individual happiness into social welfare. Egalitarian distributive justice, favoring the desert as philosophical preference, suggested to improve the welfare of the weakest in society as desirable distributive criterion. Each distributive justice has its own merits and demerits. I think that the factors of the eclectic compromising distributive justice are as follows: equal start, fair competition, minimum guarantee. Equal start means that each individual do economic activities with comparatively equal human and material resources. Fair competition means that each economic actors has equal opportunity in economic arena. Lastly minimum guarantee means that government should support the poor people by subsidizing minimum living costs.
