Abstract
This paper brings a neoclassical economic model to determine the optimal taxation rule. Utilitarian government maximizes total utility of society with proper choice of the tax parameter. Individuals have different capabilities and maximizes his or her utility with proper choice of work- leisure hours for the given tax burden. Current Korean tax system is far away from distributive justice. This paper finds the middle class income earners are paying only small amount of tax, but the optimal taxation rule based on utilitarian justice is difficult to be established under democratic election system.
