미국 본토에서 벌어진 2011년 9월 11일 테러사건은 어마어마한 희생자를 가져오고, 전세계의 국경관리기관에 가장 큰 영향을 끼쳤다. 많은 국가가 국경관리기관의 조직을 개편하고, 국경관리 역량 강화를 위해서 과거에 소수 국가가 도입했던 정보통신기술을 활용한 국경관리시스템을 대대적으로 도입하였으며, 개인정보의 활용을 강화하고자 법률을 정비하였다. 한국도 2005년부터 세계적인 흐름에 따라서 승객정보를 활용한 국경관리 체계를 도입하여 지속적으로 발전시켜왔다. 대량의 개인정보를 전자적 방식으로 처리함에 따라서 개인정보의 남용, 오용, 정보의 자기결정권의 침해 우려 또한 증가해왔다. UN 안전보장이사회는 테러전투요원을 차단하기 위하여 항공기 승객정보의 활용이 촉구하는 결의를 채택하였고, 2017년에 국제민간항공기구(ICAO)는 승객정보 활용을 국제민간항공협약 부속서(annex 9)에 규정함으로써 규범력 있는 국제법으로 형성되었다. 특히 2020년 승객예약정보(PNR)에 대한 국제적인 기준을 마련하여 승객정보의 활용과 개인정보의 보호를 강화하고자 하였다. 이에 따라 한국의 국경관리에서 항공기 승객정보의 효율적인 활용과 개인정보 보호의 조화를 위한 법률적인 개선 방안을 모색하고자 한다.
Abstract
The terrorists attacks on 9·11 2001 in the mainland of US caused large numbers of victims and shocked people all countries. It was the most significant incident against border management agencies in the world. Many countries have reorganized border management agencies and introduced extensively Information & Communication Technology to strengthen border management capabilities and amended laws to collect widely personal data. Since 2005, Korean immigration agency has also continuously developed border management systems by using passenger data from airline carriers following the global trend. The UN Security Council urged the member states to introduce the information system of using passenger information to protect country from terrorist activities. Since 2017, international criteria have been formed by amending the annex 9 of Convention on international civil aviation (Chicago Convention). To improve border management capabilities and to protect privacy of passengers, Korean border management agencies should take appropriate measures to enhance cooperation among border agencies and to ensure legal system protecting the privacy of passengers.
