법학과 정치학 및 사회학의 범주로서의 힘(=권력)

본 논문에서는 법학적, 정치학적, 사회학적인 연구들에서 종종 연결되지 않은 채 병존시키는 방식으로 존재하는 힘(=정치적 권력과 금권 등을 내포, 이하 같다.)에 관한 아래의 세 가지 관점을 서로 연결시키고자 시도하고 있다. 아래 힘(권력)의 세 가지 관점 즉 육체적·물리적 직접성, 집단적 도덕성, 법의 제3자 중재성은 서로 분리(격리)될 수 있는 것이 결코 아니다. 다시 말해 인류 보편자로서의 힘은 삼면으로 상호의존적인 육체적·물리적 직접성, 규범적인 집단적 도덕성과 법의 제3자 중재성의 분리를 허용하지 않는다.(힘의 개별화 → 힘의 도덕적 집단화 → 힘의 사건별 개별화를 통한 정당한 힘의 잠정적인 이상적·상징적·생산적 일반화) 이것으로 아래의 힘 내지 권력 내용들의 융·복합과 함께 하버마스의 소통권력/도구적 권력의 이중성의 비판적 관점 문제와 루만의 권력/권력수단-구별 및 공생이 아울러 가지는 비폭력적·상징적 권력의 문제는 나름의 원효의 일심·화쟁사상에 의거한 평화적 해결의 길을 찾을 수 있었다. 1. 힘은 참여자의 관심(주목)을 거의 완전히 흡수하거나 내지는 흡수할 수 있는 하나의 육체적·물리적 상호작용이라는 관점. 2. 힘 행사자는 기대의 실망에 반응하고, 그리고 이 기대에 대해 반-사실적(규범적)으로 고착되어 있는 것을 서술하는 관점. 곧 규범적 기대들에 대한 참을 수 없는 침해에의 반작용으로 어떤 사람은 힘을 통해 하나의 규범적인 요청을 하고 그리고 상대방(타자)을 규범적인 기대를 침해할 수 있는 타아(Alter Ego, 사실상 자아인 두뇌속의 다른 자아, Fichte)와 동일시하는 관점. 3. 힘 행위를 통해 주장되는 규범적 요청은 그것이 제3자(입법, 행정, 사법 등)를 통해 정당화되는 경우에 일반화된 방식으로 유효하게 되는 관점. 곧 그 정당성이 주장되거나 혹은 다투는 힘은 두 행위자들 사이뿐만이 아니고 항상 제3자와 관련하여서도 나타나게 되는 관점.
Abstract
General legal and social theory hardly been concerned with violence. The closest to constituting an exception to this rule are Weber and Foucault. But they largely pass over the symbolic, order-generating significance of violence, plays a general role in the formation or order. In this article I argue that the general significance of violence for order formation can only be grasped if sociation is conceptualized starting from embodied actors and systematically takes the figure of the third into account. Doing so leads to the following hypotheses about violence: violence is an antagonistic bodily interaction that communicates moral claims in a symbolically generalized way in reference to a third party.
