초국가적 이주와 다문화 사회의 시민권-필리핀 여성의 일본이주와 국제혼외자의 국적문제를 중심으로-

이 글은 1980년대부터 일본사회로 이주하기 시작한 필리핀 여성과 일본 남성 사이에서 태어난 ‘국제혼외자’의 국적 문제를 통해 초국가적 이주와 국적, 그리고 시민권의 정치를 살펴본다. 2008년 국제혼외자 국적 소송의 판결이 있기까지 비법률혼 관계의 외국인 여성과 일본 남성의 자녀들은 국적법상 일본 국적 취득이 불가능하였다. 국제혼외자들은 법적소송과 대법원 판결을 통해 부모의 법률혼을 자녀의 국적취득의 조건으로 한 국적법 조항의 개정을 이끌어냈으나, 이들의 국적취득이 미혼의 외국인을 어머니로 가진 혼외자라는 틀을 벗어나 일본사회의 완전한 구성원으로서의 실질적 시민으로 인정받는 충분조건이 되지는 못한다. 이 글에서는 국제혼외자의 국적과 시민권의 제문제의 본질을 일본의 법체계의 문제라는 틀을 넘어서 초국가적인 이주의 구조 및 가족제도를 매개로 한 일본 국가와 구성원 사이의 관계성 설정에서 찾는다. 따라서 먼저 젠더화된 여성 노동의 국제분업의 구조를 통해 국제혼외자의 어머니인 필리핀 엔터테이너 이주 여성의 이주와 정착의 특성을 살펴보고, 이 구조가 어떻게 국제혼외자의 문제를 심화시키고 있는지를 살펴본다. 다음으로 일본 국민의 범주가 일본의 특정 가족제도와 규범에 의해서 재생산되고 있음을 논하고 이러한 가족제도 및 규범이 어떻게 국제혼외자의 시민권을 제한하는 구조를 형성하고 있는지 논한다. 이를 통해 지난 20년간 진행되어온 일본형 다문화화의 특징과 갈등의 단면을 조망하고자 한다.
Abstract
Until the revision of the Nationality Law in Japan in 2008, children born out of wedlock between foreign mothers and Japanese fathers were not eligible for Japanese nationality. The ‘international illegitimate children’ born out of Philippine women and Japanese men filed a lawsuit demanding equal treatment in obtaining Japanese nationality and won the case in the Supreme Court in 2008. This case of ‘international illegitimate children’ brought to great attention the discrimination of the Nationality Law and basic human rights of foreign residents in Japan. This case, however, proposes more complex questions than the children’s legal rights to nationality; how do interracial children, particularly born out of Philippine women and Japanese men, come to existence in the first place and emerge as a socially marginalized and legally ‘illegitimate’ group?; does Japanese government’s policies exert any influence on the structure of transnational migration and settlement of foreign women and their children in Japan?; does formal Japanese nationality guarantee full citizenship for those interracial children in Japanese society? This article delves into these questions by examining the ways in which citizenship of interracial children in its broad sense intersects with the gendered nature of transnational migration of their mothers and the dominant forms of family institutions in Japanese society.
