위험물 선적으로 발생한 손해에 대한 책임문제를 둘러싸고 오랫동안 많은 논의가 이루어져 왔다. 특히 운송 중에 화물의 위험적인 특성의 발현으로 선박 자체 또는 선박에 적재되어 있는 다른 화물에 손해를 초래한 경우에 이러한 손해에 대한 책임을 누가 부담해야 할 것인가 하는 문제이다. 이러한 문제를 해결하기 위하여 다양한 합리적인 논리가 전개되어 왔으나 기본적으로는 송하인의 엄격책임을 인정하면서 운송인측의 화물취급상의 행위도 고려하여 송하인의 엄격책임을 제한하는 새로운 해석이 나오기 시작하였다.
Abstract
This article reviews the nature of the liability for shipment of dangerous goods. The dispute between shippers and carriers on the point of liability for shipment of dangerous goods has been the subject-matter of much controversy ever since the decision in Brass v. Maitland some 150 years ago. Under the common law, shipper is strictly liability for loss caused by inherently dangerous shipments where neither the shipper nor the carrier appreciates that the cargo is inherently dangerous. However, carrier cannot invoke strict liability under COGSA if it knows that the cargo poses gander and requires gingerly handling or stowage, and nevertheless exposes cargo to general condition that triggers known danger, regardless of whether carrier is aware of precise characteristics of cargo.
