본 논문은 다가오는 블록체인 3.0시대를 맞이하여 전 세계적으로 이슈가 되고 있는 ESG경영과 블록체인를 접목한 활용 사례를 소개하고 법제적 과제를 검토하는 것을 목적으로 한다. 블록체인 기술은 환경측면에서 ESG공시, 계약전자화 등에 실제 활용되고 있으고 활발하게 연구되고 있다. 특히 글로벌 ESG공시의 경우 수출업체, 수입업체뿐만 아니라 분산원장에 공급망 업체, ESG 평가사 등이 참여하도록 하도록 하여 계약 및 지급결제를 전산화하면서 검증된 ESG데이터를 수집할 수 있어 데이터의 수준과 업무 효율을 제고하면서 지급결제의 혁신을 이루어낼 수 있다. 사회적 약자 보호 측면에서도 기부금 관리, 내부고발자 보호에 블록체인 기술이 활용될 수 있고 지배구조 측면에서도 분산원장을 활용한 전자주총 개최, 탄소저감량과 같은 분산원장의 데이터를 기반으로 한 성과 기반의 임원보수 설계 및 지급 등에 활용될 수 있다. 본 연구가 블록체인 기술을 통하여 ESG 경영의 진정성을 높이고 블록체인에 대한 부정적 시각을 해소하는 데 일조하기를 바라며 논문을 마무리한다.
Abstract
This study aims to introduce the use cases and review the legal issues of combining ESG management and blockchain, which is becoming a global issue in the upcoming Blockchain 3.0 era. Blockchain technology is actively explored and used for ESG disclosure and paperless contract in the environmental field. In particular, in the case of global ESG disclosure, not only exporters and importers, but also supply chain companies and ESG assessors can participate in the distributed ledger to collect verified ESG data while electronicizing contracts and payments, thereby improving data quality and work efficiency while innovating payment settlement. In terms of social protection, blockchain technology can be used to manage donations and protect whistleblowers. In terms of governance, it can be used to hold electronic shareholder meetings using distributed ledgers and to design and pay performance-based executive compensation based on data from distributed ledgers, such as carbon reduction. This paper concludes with the hope that this research will contribute to enhancing the authenticity of ESG management through blockchain technology and dispel the negative view of blockchain.
