Abstract

This study examines the limitations of the current operation of the Protection of Communications Secrets Act and the exclusionary rule with respect to unlawfully obtained recordings, particularly where the protection of socially vulnerable persons, such as children and persons with disabilities, is at stake. As recording technologies have become increasingly accessible, private recordings are widely used to resolve disputes and prevent harm. Nevertheless, Korean law generally prohibits recordings made by third parties who are not participants in the conversation and strictly limits the admissibility of unlawfully obtained recordings. Consequently, so-called proxy recordings made by guardians to uncover child abuse or abuse against persons with disabilities are likely to be regarded as unlawfully obtained evidence. This study argues that the principal problem is not merely the absence of explicit statutory exceptions for proxy recordings, but the rigid exclusionary structure created by Article 4 of the Protection of Communications Secrets Act, which substantially limits the possibility of admitting unlawfully obtained recordings through balancing of interests. Although Korean courts generally recognize balancing under the exclusionary rule, they rarely engage in meaningful balancing where recordings have been obtained in violation of the Act. An analysis of Supreme Court Decision 2020Do1538 and Suwon District Court Decision 2022GoDan7025 shows that the appellate courts focused primarily on the illegality of the recording itself while giving little consideration to balancing at the evidentiary stage. As a result, once a recording is deemed unlawful, the possibility of admitting it as evidence is effectively foreclosed. This study therefore argues that the current framework should be made more flexible by allowing greater consideration of balancing through judicial interpretation. At the same time, given the long-standing judicial approach, interpretive solutions alone are unlikely to provide a sufficient remedy. Accordingly, legislative reform should also be considered, including revising Article 4 of the Protection of Communications Secrets Act to permit greater flexibility in determining admissibility and, where necessary, introducing narrowly tailored exceptions for proxy recordings in limited circumstances. Ultimately, the central task is to establish a legal framework capable of balancing privacy protection with the protection of socially vulnerable persons through clear and carefully defined standards.
