(Gender-based violence and sexual offences)’로 포괄하여 정의할 필요가 있다.

Abstract

The concept of digital sexual crimes must encompass its nature as a crime that extends beyond online spaces into the physical world. Accordingly, digital sexual crimes should be broadly defined as “various forms of gender-based violence and sexual offenses mediated by digital technologies.” Such violence occurs extensively across both online and offline contexts, either simultaneously or sequentially, and is most prominently observed in cases of sexual violence against children and adolescents mediated by technology. Emerging digital devices and network environments have facilitated crimes such as non-consensual distribution of videos, deepfake production, and technology-enabled stalking through location-tracking systems. These offenses transcend temporal and spatial boundaries between cyberspace and reality, characterized by organic interconnectedness and unlimited replicability. This study examines the concept and characteristics of digital sexual crimes and further explores the limitations and challenges of current victim support systems. Responses to digital sexual crimes must not be confined to punitive measures alone; rather, they should enhance investigative efficiency while simultaneously strengthening victim support to ensure practical effectiveness. Effective countermeasures require fostering the perception that offenders will inevitably be apprehended, alongside developing systematic legal frameworks centered on prevention, including international cooperation and reinforced accountability of platform providers. In particular, addressing digital sexual crimes against children and adolescents demands not only retributive punishment to realize social justice but also sufficient attention to supporting victims in restoring their lives and daily routines.
