Abstract

It is difficult to discuss copyright infringement or plagiarism when it comes to professional writings of judges, prosecutors, and attorneys at law. Meanwhile, in the United States and Japan where advanced legal culture is established, such issues are not only being discussed in a substantial level, but have resulted in many actual cases. As social awareness toward copyright and plagiarism has grown and competition within the legal market has deepened, it has become inevitable for lawyers to face plagiarism issues, as a high level of integrity and moral awareness are expected from them. However, although lawyers cannot be exceptions, indiscriminate disputes over plagiarism can end up being a tool for insignificant quarrels, failing to grasp the original goal of improving academic integrity and awakening moral awareness within the legal profession. This paper attempts to found a basis for rational discussion over the impending plagiarism issues within the legal profession. When writing judgments, judges may refer to articles of scholars whose original theories have never been introduced before. In such a case, citation must be duly done when the judgment includes an expression or an original idea from a different source. Even taking into consideration that the level of academic integrity cannot apply to the same extent to judgments as in comparison to scholarly articles, judgments without proper citation are still subject to violations of the duty of indication of sources under existing copyright legislation. Amending the copyright law cannot be the best cure to alleviate the arising difficulties when judges pursue their occupational duties. It is not only unnatural but irrational to disregard reality and follow the convention when social awareness toward copyright and plagiarism has been heightened to an incomparable degree compared to the past. As of now, it is unavoidable that academic works of judges are also subject to the writing ethics widely accepted in academia. In regards to attorneys at law, considering their professional traits, their writings are strongly connected to economic interests. Thus, copyright infringement has more potential than plagiarism to put lawyers into serious trouble, which shall soon surface as the competition within the legal market becomes fiercer. Although there has yet been any social controversy raised against lawyers’ occupational or academic writings that turned into a decision to eventually harm their professional career or status, considering the cases in other countries with advanced academic or legal culture, it is anticipated that disciplinary actions based on plagiarism in the legal field where a strict level of integrity and moral consciousness is required are soon likely to take place in this country as well. This paper will trigger disputes in many dimensions. I hope discussions flourish through debates and criticisms from this paper.
