창성능개선과 창성능개선 사전연구는 2021년부터 시범사업으로 도입되어 시행중인 사업이다. 창성능개선은 기존의 창정비 개념에 운영·유지를 위한 추가성능개선 사항을 적용하는 ‘진화적 창정비 개념’이다. 본 연구는 창성능개선과 창성능개선 사전연구 제도가 내실 있게 시행되기 위하여 법제도적 관점에서 살펴보았다. 방위사업법 등 방위사업과 관련된 법령들을 검토하여 창성능개선과 사전연구의 법적 근거를 확인하고, 시범사업 결과에서 도출된 법제도적 보완사항을 검토하였다. 연구결과, 현재의 창성능개선과 사전연구 제도는 방위사업법에 법적 근거 제시가 미흡하며, ‘창성능개선’과 유사한 용어들이 방위사업 법령에서 사용되고 있는 문제점을 식별하였다. 또한, 주요 내용을 규정한 ‘총수명주기관리업무 훈령’도 개정 소요를 도출하였다.
Abstract
Depot performance improvement and preliminary research on depot performance improvement are projects that have been introduced and implemented as pilot projects since 2021. Depot performance improvement is a 'evolutionary depot maintenance concept' that applies additional performance improvement matters for operation and maintenance to the existing depot maintenance concept. This study examined the depot performance improvement and depot performance improvement preliminary research system from a legal and institutional perspective in order to be implemented substantially. Laws and regulations related to defense business, such as the Defense Acquisition Program Act, were reviewed to confirm the legal basis for depot performance improvement and prior research, and the legal and institutional supplements derived from the pilot project results were reviewed. As a result of the study, the current depot performance improvement and preliminary research system are insufficient to present the legal basis in the Defense Acquisition Program Act, and the problem that terms similar to 'depot performance improvement' are used in the Defense Business Act was identified. In addition, the 'Total Cycle Sytem Management Service Directive', which stipulates the main contents, also derives the need for revision.
