Abstract
As electronically stored information becomes a primary target in the US E-discovery, there is an increasing number of failures to fulfill the duty of preservation. For this reason, the legal hold is recognized as an essential procedure in the E-discovery. However, in contrast to this importance, there are no explicit grounds under Federal Rules of Civil Procedure for the duty of preservation and the legal hold. In other words, while the use of the legal hold is recognized to be an essential procedure, it is a situation where unnecessary disputes or problems may arise in practice because the law does not specify specific contents. In response, Sedona Conference established guidelines on the legal hold, and published the Commentary on Legal Holds, The Trigger & The Process in 2010. The Commentary on Legal Holds, Second Edition: The Trigger & The Process was released in September 2019, reflecting the 2015 amendments to the Federal Rules of civil Procedure, data protection laws and regulations and the Sedona Principles, Third Edition: Best Practices, Recommendations & Principles for Addressing Electronic Document Production in 2017. The Commentary on Legal Holds, Second Edition: The Trigger & The Process basically provide guidelines for the timing of the preservation obligations, the subjects of preservation, and procedures for implementing the duty of preservation. In particular, it emphasizes (1) reasonableness, good faith and proportionality, and (2) periodic management and education of legal hold There is no discovery under the civil procedure in Korea. However, considering the introduction of the discovery, the possibility that similar problems may arise depending on the nature of the electronically stored information, and that there are cases where evidence preservation is required in international cases, the Commentary on Legal Holds, Second Edition: The Trigger & The Process should be reviewed. It is worth it. In this regard, this article briefly summarized the basic contents of the legal hold, and reviewed the details of the Commentary on Legal Holds, Second Edition: The Trigger & The Process and implications for our system.
