Abstract

Modifiability of electronically stored information(ESI) with immensity and specialty makes lots of problems such as growth of spoliation possibility, breach of the duty of preservation, sanctions for ESI losses, over-preservation, and preservation cost increase. As part of the 2006 E-discovery amendment of the Federal Rules of Civil Procedure(FRCP), Rule Committee adopted a restriction on sanctions for ESI losses in what is now rule 37(e) for solving the problems, but the reality is not greatly improved. Recently, the amendments to the FRCP regarding E-discovery which were forwarded to Congress by the Supreme Court. Reviewing the existing regulations, limits of them, discussions for improvement, and amendments in U.S. E-discovery will provide the foundation to reduce trial and error if we introduce the same system, considering the reality of the discovery is expected to be introduced and necessity of restriction on sanctions for ESI losses. This article reviewed the contents of the existing rule 37(e), the limits of rule 37(e), the progress of amendment, the contents of the proposed amendments. And what to consider when introducing the restriction on sanctions for ESI losses in E-discovery summarized as follows: First, it requires specification of the criteria for the restriction on sanctions for ESI losses. Second, there is a need to limit the subject. Third, the restriction on sanctions for ESI losses is necessary, but should be exceptional.
