제대로 된 치료를 받지 못한 주취․정신장애범죄인과 마약류범죄자가 반복하여 범죄를 저지르고 있으며 또한 이들이 최근 묻지마 범죄 등과 같은 더 큰 범죄로 나아가는 문제점을 개선하기 위하여 경미한 범죄를 저지른 주취․정신장애범죄인과 마약류범죄자에게 통원치료의 기회를 받을 수 있도록 국가가 개입하는 치료명령제도가 도입되었다. 하지만 치료명령의 대상 범위, 대상자의 동의 여부, 치료감호 후 치료명령의 연계부족, 민간단체와 유기적 협력의 부족과 이를 관리․감독할 통할기관의 부족 등의 문제점이 있다. 이를 해결하기 위해서는 전문성과 함께 유기적 통합관리가 가능하도록 법관, 정신건강의학과 전문의 그리고 사회복지전문가가 함께 참여하는 치료감호 및 치료명령 전담재판부를 신설할 필요가 있다. 치료감호법, 치료감호시행령 그리고 치료감호시행규칙에 치료명령 집행 후의 후속조치에 대한 규정을 만들어야 한다. 치료감호법 제36조의2를 치료명령대상자에게도 준용하는 규정을 마련하여 치료명령 후 상담, 진료, 사회복귀훈련 등 정신건강복지센터의 정신보건서비스를 받을 수 있도록 하여야 한다. 이를 위해 치료감호시행령에 치료명령 집행 후의 후속조치에 대한 세부 규정이 필요하다. 치료감호 후에도 치료명령을 받을 수 있도록 함으로써 치료와 관리가 연계되도록 하여야 한다. 치료명령 대상자의 동의를 치료명령의 선고요건으로 함으로써 치료효과를 증대시켜야 한다. 지역사회자원을 활용하기 위하여 유기적인 협력체계가 필요하며 이를 관리하고 감독할 통할기관이 지정되어야 한다.
Abstract
In order to remedy the problems that alcohol-induced offender or mentally disordered offender who have not been treated for the sickness are repeatedly committing crimes and make serious crimes such as Do-not-ask Crime, Treatment Order was legislated. However, there are problems such as the scope of the treatment order, the consent of the subject, the problems of early intervention such as at the police investigation stage, and the lack of organic cooperation with private organizations. In order to solve this problem, drug offenders who are at high risk of recidivism should be included in the treatment order. The effect of treatment order should be increased by making the consent of the subject. Treatment should be coordinated with management by allowing treatment order to be given even after supervision. An organic cooperation system is needed to utilize community resources and a control tower to manage and supervise them.
