독일의 탐정 산업의 발전 및 운용에 관한 법적 근거 및 규제 방안

‘탐정(민간조사업)’이란 국가 기관의 수사력이 미치지 못하거나 미흡한 각종 범죄나 사건에 대한 사실관계 조사 또는 실종자 소재 탐지 등에 있어서 사인의 다양한 권리구현을 위해 의뢰인을 대리하여 사실을 확인해 주고 누구나 접근 가능한 정보의 수집을 대행하는 서비스업을 의미한다. 민간조사업에 대한 논의는 2013년 3월 민간조사업에 관한 법률안(송영근의원 등 15인)이 발의되었고, 2015년 11월 민간조사업의 관리에 관한 법률안(윤재옥의원 등 10인)이 발의된 이후 우리나라 ‘탐정’으로서 민간조사업에 대한 논의는 아직은 그 성과를 보지 못하고 있는 실정이며, 우리나라와 연역적으로 유사한 점이 많은 독일의 탐정제도에 대한 연구는 탐정제도의 신속한 도입을 위하여 필수적임에도 미흡한 실정이다. 이에 이 논문에서는 독일의 탐정제도의 발전과정 및 탐정의 활동 영역 등에 대하여 자세히 살펴보았으며, BDD, BID, ZAD 등 독일의 탐정협회를 중심 탐정 산업에 대한 지원 및 향후 발전 계획 등을 확인해 보았다. 또한 독일 탐정 산업의 인정 근거로서의 법률 규정으로서 독일 직업법(GewO) 및 규제를 위한 독일 기본법(GG), 독일 민법(BGB), 독일 형법(StGB), 독일 형사소송법(StPO), 데이터보호법(BDSG), 독일 통신법(TKG) 등 관련 법규에 대한 적용을 살펴보았으며, 나아가 독일의 협회가 정한 ‘독일탐정직업강령’이 규정한 탐정의 권리·의무사항 및 업무의 수행을 위한 기준 등을 확인하였다.
Abstract
Detective (private assistance project) means verifying the facts on behalf of clients in order to implement various rights of the cause of death in the investigation of facts or detection of missing persons for various crimes or events that are insufficient or insufficient for investigation by the state agencies. Means a service industry that collects the possible information. Discussion on how to introduce 'detective' as a private investigation system has been conducted for many years through the proposal of legislation, but it has not been able to see the results yet. It is essential. In this paper, the development process of the German detective system and the activities of detective activities were examined, and the associations such as BDD, BID, and ZAD were identified to support the central detective industry and plan for future development. It also examined the application of the German Civil Code (BGB), the German Criminal Code (StPO) and other relevant laws and regulations for the recognition and regulation of the German detective industry. The criteria for the detective's obligations were identified.
