Abstract

The way humans establish relationships of trust for the first time is through promises. Breaking a promise does not incur any legal sanctions, yet people believe that promises should not be broken and that those who do break promises cannot escape moral blame for failing to fulfill their obligations. The moment a promise is made, the person is bound to the future actions they have committed to. The fact that the act of promising creates a binding obligation that did not exist before has troubled many philosophers for a long time. Hume asks why a unilateral act of promising has binding obligation and why, even in cases where no harm results from breaking the promise, it is still considered wronging the promisee. Hume grounds the binding nature of promises in a convention arising from self-interest, stating that this convention generates moral feelings in us and compels us to keep promises even when it is not in our interest. However, this explanation fails to account for why promises have binding obligation even when it causes no harm to the promisor, promisee, or the convention itself. Contractualism, as proposed by Rawls and Scanlon, finds the binding nature of promises in the just agreement among members. Rawls assumes a social practice that enables promises and justifies the binding nature of promises through principles of justice that members must follow, while Scanlon attempts to justify it without assuming such social practices, instead relying on the ‘principle of fidelity’ derived from his moral principles. However, contractualism, which justifies the binding nature of promises through just agreement, cannot resolve Hume’s problem. This paper examines the promise theories of Rawls and Scanlon, explores why these two positions fail to provide a solution to Hume’s problem through the limitations of contractualism, and considers a way to justify the binding nature of promises without relying on contracts through the example of false promises in Kant’s ‘Groundwork of the Metaphysics of Morals’.
