트럼프 2.0 시대는 ‘미국 우선주의(America First)’를 기조로 한 보호무역주의 정책의 재등장을 예고하며, 이는 디지털 무역 분야에 있어서도 예외는 아닐 것으로 예상된다. 본 논문은 이러한 배경에서 트럼프 1.0 행정부와 바이든 행정부 시기의 對韓 디지털 무역장벽 논의를 비교하고, 트럼프 2.0 시대에서의 변화 가능성을 전망한다. 트럼프 1.0 행정부는 미국 빅테크 기업의 글로벌 경쟁력 강화를 목표로 데이터 이전 자유와 데이터 현지화 요건 금지 등을 강조하였다. 이러한 기조는 바이든 행정부에서도 유지되어 왔으나, 2023년 WTO 전자상거래 협상에서 ‘충분한 정책 재량’을 언급하며 기존 입장을 선회하였다. 이는 2024년 미국 무역대표부의 국별 무역장벽보고서에서도 확인된다. 그러나 이러한 완화된 접근 방식에 대해 공화당 의원 중심으로 상당한 비판이 제기된바, 트럼프 2.0 시대에서는 디지털 무역 자유화에 기반한 원칙적 입장으로 돌아설 가능성이 높다. 한편, 한국의 위치 기반 데이터 수출제한, 망 사용료 부과는 반복적으로 제기된 최근의 디지털 무역장벽 문제인바, 차기 트럼프 행정부에서도 다시 한 번 핵심 쟁점으로 부각될 가능성이 있다. 다만 국가안보, 정당한 공공정책 목적을 고려하여 디지털 무역 자유화와 디지털 주권 간 균형을 도모하는 전략적 대응으로 첨예한 통상 문제로의 비화는 방지할 수 있으리라 사료된다.
Abstract
The Trump 2.0 era has been marked by the resurgence of protectionist policies based on the “America First” doctrine, and this is expected to be no exception in the digital trade sector. Against this backdrop, this paper compares the discussions on digital trade barriers against Korea during the Trump 1.0 administration and the Biden administration, and forecasts the potential for change in the Trump 2.0 era. The Trump 1.0 administration placed significant emphasis on the free flow of data across borders and the prohibition of data localization requirements, with the objective of enhancing the global competitiveness of American big tech companies. The Biden administration has maintained this tone, but has reversed its position by mentioning “enough policy space” in the 2023 WTO e-commerce negotiations. This is corroborated by the ‘2024 National Trade Estimate Report on Foreign Trade Barriers’ report. Nevertheless, this approach has been met with considerable criticism, particularly from Republican lawmakers, and it seems probable that the Trump 2.0 era will return to a position based on digital trade liberalization. Meanwhile, Korea's location-based data export restrictions and network usage fees represent recent digital trade barrier issues that have been repeatedly raised. It is probable that they will emerge as key issues once again in the next Trump administration. However, it is believed that a strategic response that seeks a balance between digital trade liberalization and digital sovereignty, taking into account national security and legitimate public policy purposes, can prevent the issue from escalating into a sharp trade issue.
