플랫폼 운송사업과 택시산업 간 갈등완화 방안 연구

타다, 차차 등 플랫폼 운송사업자의 사업 확대로 택시산업과의 갈등이 택시종사자 국회집회, 택시기사 분신자살, 택시파업 등의 대결구도로 심화되며 갈등완화를 위한 대안 마련이시급한 상황이다. 국외 벤치마킹 사례로 미국, 호주 등의 교통네트워크회사(TNC)법 제정, 택시종사자 발전기여금 조성의 국내 적용가능성을 분석한 결과, 갈등완화를 위해 플랫폼운송사업의 무분별한 확대에 대해 일정 수준의 규제가 필요하고 제도적 미비를 통해 발생한피해에 대하여 기존 집단의 손해를 일정부분 보상할 방안 마련이 요구되는 것으로 보인다. 연구의 결과로 첫째, 「여객자동차 운수사업법 일부개정법률안」에서 대통령령과 국토부령으로 세부조건이 위임된 사항을 검토⋅선별하여 미국, 호주 사례 등을 바탕으로 시행령, 시행규칙 등과 관련된 개선사항을 제시하였다. 둘째, 택시종사자 발전기여금을 통한 종사자 처우개선을 위한 보상가능 수준은 호주 등의 1$ 부과와 유사하게 1,000원 정도의 정액제 부과방식을 도입하였을 경우, 전체 법인 및 개인 택시기사(약 7.9만명) 한 명당 연간 약 3.5백만원, 총 5년 간 17.5백만 원 수준의 금융 지원이 가능할 것으로 분석되었다. 본 연구의 정책적활용방안으로 TNC법 적용을 위해 「여객자동차운수사업법, 시행령, 시행규칙」 등에 플랫폼사업종류, 자격기준, 면허기준, 안전사항, 사회적기여금 등의 포괄⋅구체적 규제관리 사항을도출하였고 택시종사자 발전기여금 재원조성 규모 및 플랫폼 규모 경제화 방안, 플랫폼 운영을 위한 공급자 지침의 구축사항, 조직구성 등 신규 제도적 준비사항을 함께 제시하였다.
Abstract
Through the expansion of ride sharing platform services such as Tada and ChaCha, conflict with the taxi industry has resulted in taxi operators holding demonstrations in front of the National Parliament, self immolation, strikes, and other large scale confrontations, which are worsening. Urgent measures to mitigate these conflicts are needed. According to the analysis results, first of all, a thorough analysis of the “Passenger Transport Service Act”, and its executive orders and ordinances from the Ministry of Land, Infrastructure and Transport have been done. We suggest regulation and ordinance reform measures based on case studies from the United States and Australia. Secondly, taxi operator development funds could be implemented similarly to Australia’s case. In the case where a flat rate is implemented, matching the amount of Australia’s $1 to ₩1000 is recommended. Financial support is feasible where compensation will approximately be ₩3,500,000 annually, with a total of ₩17,500,000 over a five year period. According to this research, for the application of the TNC domestically, the following regulations needed to be amended to the “Passenger Transport Service Act”: classification of ride sharing platform services, qualification standards, license standards, safety issues, social contribution fund, etc. This study also suggests that the creation of the finances of the taxi operator development fund’s scope and economies of scale of the ride sharing platform services are needed. Ride sharing platform services’ operations supplier guidelines, organizational structure and preparations for new regulations and policies are also recommended.
