Abstract

Recent Apple v. Pepper of the U.S. Supreme Court seems to have identified the relationship between platform operators, contributors and users only in a series of distribution stages. Despite the lack of research on platform operators around 2010, when the incident began, the prejudice stemming from the terms open and closed transfers to concerns about competition restriction, giving lessons to be wary of false positives. This paper examines the significance of competition in the platform, the relationship between platform openness and competition restriction, and the role of platform providers in the market. In addition, by looking into the internal rules of the platform in detail, it was concluded that the duality of internal rules, which are the main considerations in determining the competitive effects in the platform, should be considered together. However, the positive effects along with the negative effects of the platform operators' internal rules should also be examined. In this regard, it was questioned whether a clear analysis is possible within the existing competition law system. Also in Apple v. Pepper, we examined whether the foreclosure effect in the aftermarket, which plaintiffs claimed as the reason for the claim, was examined in detail by comparing it with the Kodak case. At the conclusion of this paper, the practical consideration was given to the application of competition law to the digital platform. Platform operators function not only as intermediary we know well, but also as market makers or mixed types, and we select them individually if it is in our favor. This paper raises the necessity of clearly establishing the significance of the intermediaries, the competitive effects, and the analysis system in accordance with the competition law. Finally, the direction for improvement in the Korea Fair Trade Act was briefly mentioned in the context that the 10th amendment to the German competition law was submitted.
