Abstract
With the establishment of the rule of law and the diversification of society, the number of laws and autonomous regulations has been continuously increasing. As a result, the legal framework has become increasingly complex, raising ongoing issues regarding the interpretation of relationships between laws and local regulations, as well as whether autonomous regulations violate higher-level laws. The authoritative interpretations provided by the Ministry of Government Legislation serve to unify the government's stance when interpretations of laws diverge among administrative agencies. These interpretations are particularly useful for local governments as they do not require conditions such as direct disposition or self-relatedness, allowing preemptive legal validation before administrative actions are taken. Many interpretive issues arise concerning local governments, including questions of authority between central and local administrations, and whether specific matters should be governed by national law or local ordinances. While some problems stem from local governments misinterpreting laws or drafting flawed regulations, others arise from the ambiguity or inherent limitations of higher-level laws that restrict local autonomy. Since legal interpretation must adhere to existing laws, this can result in interpretations that inadvertently constrain local autonomy, regardless of their normative validity. Therefore, analyzing interpretation cases related to local autonomy can reveal systemic flaws in current laws and inform legislative improvements aimed at strengthening local governance. This paper examines interpretive cases concerning: (1) whether a matter falls under the category of autonomous affairs; (2) the scope of regulation through ordinances and rules, including the division of powers between local councils and local executive heads; and (3) the limitations imposed on local legislation by national laws and administrative rules. Based on this analysis, the paper proposes legislative reforms to address current regulatory shortcomings. In recent years, the Korean government has made continuous efforts to enhance local autonomy by revising numerous laws. In the legislative process concerning the authority of local governments, procedural and institutional frameworks have been established through mechanisms such as prior consultation on decentralization and coordination among relevant agencies during law drafting. In addition to these individual legislative amendments, there has been a growing trend of incorporating general provisions—such as Article 28(2) of the Local Autonomy Act—that explicitly aim to strengthen local legislative authority. It is expected that, by combining these general principles with continued efforts to revise individual laws, a more coherent and responsive legal system that effectively guarantees the autonomy of local governments can be established more efficiently.
