국회는 지난 2009년 농협법 개정(법률 제9761호, 2009.6.9)으로 농협중앙회장 선거방식을 ‘직선제(전체 회원조합장이 선출)’에서 ‘간선제(대의원 조합장이 선출)’로 변경하고, ‘중임 제한 규정’을 신설한 바 있다. 그런데, 이에 대한 개정 논의가 지속적으로 진행되고 있고, 국회에 관련 법안이 발의되어 있다. 이 사례연구에서는 이러한 쟁점들에 대해 법적 검토를 하였다. 협동조합 기본원칙(‘민주적 관리’, ‘자율과 독립’) 및 헌법 규정(협동조합 자율성 보장)이 우선적으로 고려되어야 한다는 내용을 담았다. 결론으로서, 직선제를 채택하는 것이 합리적이라는 점(부가의결권은 배제), 연임(1회) 허용문제는 조합장들의 의견을 들어 방향을 정하는 것이 합리적이라는 점을 제시하였다.
Abstract
The National Assembly had revised election-related regulations in the Agricultural Co-operative Act and has changed the Election-System of the NACF President from a direct election system (all union presidents elect) into an indirect election system (representatives elect) and has newly established stipulations prohibiting reappointment in 2009. Recently, there have been discussions over the necessity of the revision on these stipulations, and related bills have been submitted to the National Assembly. This paper reviews these issues from a legal point of view. It suggests that the cooperative- principle (Democratic Member Control, Autonomy and Independence) and the constitutional stipulation regarding the autonomy of the cooperatives should be respected. In conclusion, this paper proposes to adopt a direct election system and allow reappointment.
