플랫폼 시장이 급성장하고 불공정행위 문제가 지속적으로 제기되는 상황을 지적함과 동시에 혁신을 통하여 플랫폼 시장을 육성하기 위한 목적에 따라, 정부는 국정과제에 포함된 ‘온라인 플랫폼에 대한 자율규제’를 실현하고자 ‘범부처 플랫폼 정책협의체’를 구성하고, 민관합동 기구를 중심으로 자율규제의 방안을 검토하기 시작했다. 이와 같은 규제방식의 변화는 지금까지의 규제가 결국 효과적이지 못하였다는 성찰적 사고에서 기인하는 것으로 볼 수도 있으며, 산업발전과 규제 목적을 조화롭게 모색하고자 하는 새로운 방식에 대한 필요성을 의미하기도 한다. 국내에서 자율규제는 극히 일부의 영역에서만 예외적으로 이루어져 왔는데, 이를 플랫폼 산업 전반으로 확대하기 위한 논의가 정부 차원의 입법론과 함께 최근 들어 다시금 활성화되고 있다. 이에 본 논문에서는 자율규제의 의의, 전자상거래 플랫폼에 대한 자율규제의 적정성, 요인과 방향성, 비교입법례 등을 총론적인 차원에서 검토하고, 규제개선 방안으로 자율규제를 제안하고자 하였다.
Abstract
In order to realize ‘self-regulation of online platforms’, the government has formed a policy consultative group in which relevant ministries participate. In addition, a plan to introduce self-regulation is being considered at the level of a public-private joint organization. This change in regulation methods is due to the reflective thinking that the regulations so far have not been effective. And it also means the need for a new way to harmonize industrial development with regulation objectives. In Korea, self-regulation has been applied as an exception in only a few areas. However, discussions to expand self-regulation to the entire platform industry have recently become active along with the government's legislative plan. Therefore, in this paper, the definition of self-regulation, the appropriateness of self-regulation for e-commerce platforms, factors and directions, and comparative legislation were reviewed in general. In addition, self-regulation was proposed as a method of regulation improvement.
