Abstract
This paper aims to investigate the usefulness of the anthropological approaches to the study of the adjudication and to examine the court talks that are manifested in the jury trials in Korea. Linguistic arguments in the court can have some regularity in communication styles and in delivering forms and they are received differently in terms of persuasion and reliability. In this study, a total of 17 jury trials, between February 2009 and August 2009, were observed. Court languages used in the testimony in four cases were transcribed and analyzed. Speech styles in Korean jury trials reflect the similar patterns as foreign cases, such as 'powerful-powerless speeches,' and 'rule-based vs. relation-based' speeches, and these initial results may be used to further the analysis in the future studies. In addition, several speech strategies suggesting patriarchal, emotional, regionalistic aspects are frequently manifested in the data. Participants in the court proceedings use these strategies to convince the jurors to look into the social context in the light of their common sense. Differences in social status exist in addition to differences in speech styles and orientations. Future studies on how these differences are evaluated during the process of deliberation will demonstrate how relevant and useful the court talk studies will be in linking empirical linguistic data and the macro social phenomena.
