국내 개인정보 보호규정에 유럽연합의 개인정보 보호규정이 미친 영향이 크지만, 개인정보 국외 이동과 관련하여서는 유럽연합의 규정과 국내법의 규정 간에 상당한 차이가 있다. 유럽연합의 경우, 유럽연합 역외 국가의 개인정보 보호의 적정성을 기준으로 개인정보의 국외 이동을 허용하는 반면, 국내법의 경우, 정보주체의 동의를 요건으로 하여 개인정보의 국외 이동을 허용하고 있다. 개인정보 보호의 적정성을 중요한 기준으로 고려하는 유럽연합 규정은 개인정보 국외 이동과 관련하여 유용한 규정이라고 보인다. 또한 유럽연합의 규정은 개인정보의 처리 목적을 결정하는 자와 실제의 처리자의 개념을 구분하고 있으나, 국내법은 개인정보처리자라는 용어만을 사용하고 있어서 개인정보의 처리 목적을 결정하는 자와 실제적인 개인정보 처리자 간의 개념이 혼동될 가능성이 있고 두 개념간의 권리관계가 명확하게 규정되어 있다고 보기 어렵다. 유럽연합의 개인정보 국외 이동에서의 적정성 기준은 국내법에서도 향후 반영이 검토될 필요가 있다고 보이며, 국내법의 개인정보처리자의 용어를 재검토하여 개인정보의 처리 목적을 결정하는 자를 개인정보 운영자 또는 개인정보 관리자로, 개인정보를 실제로 처리하는 자를 개인정보 처리자 또는 개인정보 취급자로 규정하고 두 권리 관계를 명확히 규정할 필요가 있다고 보인다.
Abstract
The issues regarding personal data are at the center of private, legal and economic life. Especially, the issue of transferring personal data beyond borders is one of the most critical issues in the global information age. EU Data Protection Directive and General Data Protection Regulation, ones of the strictest global regimes to protect personal data, are thought to be useful cross-border data transfer rules. According to the EU rules, the EU citizen personal data, in principle, cannot be transferred to a third country outside the EU unless the third country has adequate personal data protection. While, according to Personal Information Protection Act, once consent is obtained from the subject of personal data, his/her personal data can be freely transferred abroad, regardless of the level of personal data protection in countries to which personal data is transferred. Also, EU rules distinguish a processor from a controller, while Personal Information Protection Act just defines a processor, meaning the party to collect, create, link, interwork, record, save, hold, process, edit, search, output, correct, recover, use, provide, disclose, destroy personal information, and other acts similar thereto. Therefore, considering adequacy of personal data protection in transferring personal data abroad would be useful, and the term “a personal data processor” under Article 2(5) of the Personal Information Protection Act should be considered to explicitly distinguish a data manager or a data controller from a data processor or a data handler and to avoid confusion and evasion of personal responsibility.
