초록
해외로 개인정보가 이전되면서 우리 국민의 정보를 효과적으로 보호하기 어렵다는 문제의식이 제기되었으며, 정보주권이 제한되고 특정 국가로 국민의 개인정보가 집중되어 남용될 수도 있다는 위험성도 제기되었다. 반면 글로벌 시장에서 개인정보의 문제는 국내에서의 개인정보 문제와 다를 것이 없으며, 이제 국내외 국경의 의미는 적어도 인터넷 세상에서는 무의미해졌으며, 자칫 새로운 규제나 강화된 규제가 생겨나는 경우에 새로운 서비스와 산업의 출현이 가로막힐 수 있다는 우려도 동시에 제기된다. 이러한 서로 충돌하는 이익을 적절히 조화하면서 글로벌 시장에서의 개인정보의 적정한 보호를 위한 검토가 요구되는 시점에 왔다. 이에 따라 이 글에서는 개인정보 국외이전에 관한 외국의 입법례로서 UN, OECD, EU, 영국, 미국의 법제와 국내 법제를 검토하고, 이를 바탕으로 합리적인 법제 개선방안을 제안하고자 하였다. 법제 개선방안으로서 개인정보 국외이전의 규율의 불가피성을 인정하면서도, 글로벌 유통에 대한 과도한 규제는 억제하는 방향으로 개선이 이루어져야 한다. 또한 규율대상으로서의 개인정보 범위의 명확화, 규율대상 행위의 명확화, 분리의 원칙 확립, 국외이전 내역 통지 제도의 도입, 공동규제체계의 정립, 당사자 합의에 기초한 규율의 촉진, 거버넌스의 일원화, 한국주도의 국제공조체제 확립, 자율규제 유도 등이 추진되어야 한다.
Abstract
As our national’s personal information flows into foreign countries, some problems arise like difficulty of its protection, limitation of data sovereignty, abuse of personal information. To the contrary, reinforcement of personal information protection law might result in new barrier to international trade. Now is the time to contemplate how we harmonize two compelling interests – protection of personal information and guarantee of free information flows. From this problematic perspective, this paper deals with comparative analysis of foreign laws about transborder flow of personal information, examination of domestic laws and Korean FTAs, and suggestions on reasonable legal reform. Specially, its suggestions include recognition of inevitable regulation on transborder information flows, clear definition of personal information as an object of application, establishment of Separation Principle, introduction of cooperative co-regulation scheme, promotion of self-regulation, unification of governance, establishment of international cooperation scheme lead by Korea, etc.
