试析朝鲜行政处罚法的属性及内容体系

Abstract

The administrative punishment law of the DPRK enacted in 2004 can be regarded as the product of the combination of the general administrative law theory of the modern state and the Korean society, just like the first purpose of "establishing a strict system and order for the application of administrative punishment, preventing illegal phenomena, and establishing a law-abiding atmosphere in the whole society", It is to regulate all kinds of behaviors in the social life of citizens and maintain normal social order. By 2011, the content and system of administrative punishment had been gradually enriched through eight amendments. The law is divided into four chapters, including the structure system, the type system of administrative punishment, and the illegal behavior system. Its characteristics are as follows: first, it specifies in detail the types of illegal acts of citizens, accounting for 195 of the total 254 articles. Second, there are many state organs with administrative punishment authority, which can be said that most state organs have corresponding administrative punishment authority. Third, relief provisions and provisions are too few, and relief only stays in the appeal. Although its "administrative punishment law" is heavy punishment but light relief, it is undeniable that the administrative punishment law is an important administrative law in North Korea.
