Abstract
The purpose of this article is to clarify the characteristics of the German public law by examining the notion of violence monopoly of state in the German public law system and to suggest the implications for the public law in Korea, in particular, it aims to obtain judicial clues to secure safe state. In German public law, there are in-depth discussions on the explanation and rationalization of safe state, and various theories have been established, and at the same time, the concept of violence monopoly of state can be mentioned. The general content is, in principle, that “the legitimate exercise of violence within the state is monopolized by the state and that the use of violence by private is prohibited.” On the other hand, in Korea, whatever the status of this notion may be in the political science, the violence monopoly may be regarded as a very unfamiliar concept in the legal field. However, neighboring countries in Japan have already reviewed the violence monopoly theory of Germany as a precedent study, such as the regulation of protests, the obligation of protection of fundamental rights, the relations between civil law and constitutional law, the domain of protection of fundamental rights, and safety. However, there is very little literature discussing the significance of our constitutional interpretation or constitutional theory on the subject of violence monopoly itself. Regarding the debate on the issue of national security, despite its diverse logic, there is a particular reason to address violence monopoly. In particular, in German law, there is an analysis that, at first glance, the concept of violence monopoly, which seems to be friendly to authoritarian police state, ultimately leads to the right to trial. I was interested in the monopoly of violence in these various angles and thought that I should reveal the cause. This is due to the idea that it can give some implication to appropriate control for the safe state. In this study, I investigated why the monopoly of violence should be discussed, and then examined the monopoly theory of violence in German public law in the context of its times. Especially, in the concept of violence in the public law, the discussions of Delef Merten and Josef Isensee was examined in detail. This study explores the background of the period when the theory of violence monopoly has been actively developed, argues the criticism of protestation and advocacy of assertive action, and discusses why the argument of violence monopoly emerged. In addition to the formation of the modern state, the rationale for the substitution of violence monopoly by the right to trial is examined, and the relation between self-relief and trial is examined as a remedy for rights. I also discussed the theory of the right to bring an action in a court in civil litigation. I further explained the situation of the crack of violence monopoly theory in the modern times. In particular, since the formation of the European Union as a state alliance and the issue of violence monopoly among nations has also reviewed about how the logical structure has changed and how the monopoly of violence changes under the conditions of globalization. The academic achievement of this article is the work of exploring how justice, rights, and law should be harmonized.
