전자상거래 시장이 확대될수록 보다 많은 상거래상의 문제점들이 발생하고 있다. 정부는 이러한 전자상거래상의 문제점들을 해결하기 위한 규제방안을 만들었으나 이러한 정부규제가 모든 거래당사자들을 통제할 수 있는 최선의 방법은 아니다. 개방성과 국제성을 가진 인터넷상에서 발생하는 모든 문제를 정부의 직접규제로써 해결하는 것은 현실적으로 불가능하기 때문이다. 이 경우 거래당사자들간의 자율규제가 보다 효과적인 소비자보호의 수단이 될 수 있다. 본 연구는 전자상거래에서 발생하는 문제점을 해결하기 위한 인터넷 거버넌스와 자율규제의 개념, 요소, 주체, 적용 가능한 유형과 방법 및 외국의 자율규제 동향을 알아보고 자율규제의 장애요인과 국내전자상거래 자율규제의 현황 및 개선 방안에 대해 알아보도록 한다.
Abstract
As e-commerce market has been extended, many problems are being generated. The government designed various regulations to solve these problems. However, this is not the best way to control the market and participants of the E-trading. It is obvious that not every claims and problems which occur at online market can be controled directly by the regulations. In this case, self-regulation mighty be more effective means to protect consumers in the market. This paper examines various aspects of the E-commerce market, for instance, the concept of the internet governance and self-regulation, the applicable types to it, and the tendency of the other E-trading markets. Furthermore, as researching what are the obstacles in the domestic market, finally, it will be suggested how the self-regulation and market can be more improved and efficient.
