초록

전자상거래는 핵심주체인 기업의 국적성이 모호해지고 객체인 상품의 유형도 전통적 거래의 범위를 초월하며, 거래 시스템에 있어서도 대단히 복잡한 양상을 띠게 된다. 전자상거래 기업에 대한 국제규범 적용의 문제는 이러한 시장변화와 종래의 국제규범 적용의 괴리 가운데 놓여있다. 전자상거래 기업이 직면하는 국제규제의 분야는 주로 관세 및 조세 부과, 지적재산권, 소비자보호, 법적 관할권 등과 관련된 부문이다. 본 연구에서는 전자상거래에 대한 국제규범의 확립 논의를 살펴보고 기업관련 규제 분야에 대한 대응 정책을 분석·정리하였다. 국제기구와 주요국은 기본적으로 자유화와 민간주도의 원칙, 비합리적 규제의 철폐 등에 합의하고 있다. 그러나 개인정보의 보호, 조세 등의 이슈에서는 대립된 의견을 보이고 있기도 하다. 전자상거래 국제규제의 문제는 결국 각 국가의 자율권이 보장된 전세계적 규범의 설정과 기업 등이 참여하는 민간의 자율적 통제가 병행되어 해소될 것이다.

Abstract

Transformation of the market environment due to e-commerce has weakened the effectiveness of previously applied international rules and regulations and become a cause for conflicts among involved parties. Moreover, such tendency may lead to each country's strengthening regulations on e-commerce to remedy further ineffectiveness of international rules and regulations. However, such measures may harm the stability of e-commerce, rather than advancing it. Although the debate on new international rules and regulations is approaching a consensus, issues such as definition of jurisdiction applicable to e-commerce or accepting existing commercial boundaries among countries remain unsolved. Dispute on regulating e-commerce is most particular on the issues of taxation and protection of consumer and individual's privacy, protection of intellectual property rights, and legal jurisdiction. The international regulations on e-commerce must conform global conventions by means of international treaties and voluntary participation of commercial firms, which are the foundation of e-commerce, while ensuring the self-government of each country involved.
