후견제도에 인공지능 도입 필요성 및 방안에 대한 연구

2013년 7월부터 후견제도가 도입됨에 따라 정신적 제약으로 사무를 처리할 능력이 지속적으로 결여된 사람들의 인권과 복지가 강화될 수 있는 제도적 기반이 조성되었다. 그러나 우리의 경우 법률적 전문성이 부족한 친족이 후견인으로 선임되는 경우가 많고 후견감독인 선임 또한 미흡하여 후견인 지원·감독 업무가 가정법원에 집중되고 있다. 가정법원의 노력에도 불구하고 담당 인력 및 예산 부족으로 인하여, 급속한 고령화에 따라 향후 증가할 것으로 예상되는 후견수요에 적절히 대응하기 어려울 것이라는 우려가 크다. 공공부문 인력·예산 확보의 어려움, 후견을 가족 내에서 해결하려는 문화, 후견 전문가 이용에 따른 수수료 지불 거부감 등이 존재하는 현실에서 우리의 발전된 정보화 기반·기술과 인공지능이 융합된다면 후견제도에 있어 변화와 성과를 만들 수 있을 것으로 기대된다. 인공지능을 “인간이 가진 지적 능력을 기계적인 방법으로 구현한 것”이라 한다면, 정신적 제약으로 사무를 처리할 능력이 결여된 피후견인을 인공지능이 효과적·효율적으로 보조·지원할 수 있기 때문이다. 본 연구에서는 인공지능이 후견제도에 도입되었을 경우 법적 지위, 기능과 효과 및 관련된 법률적 쟁점을 다루었다. 첫째, 인공지능 자체가 후견인 등의 역할을 하는 것과 후견인 등이 인공지능을 수단으로 이용하는 것에 대해 후견제도의 특성을 고려하여 검토하였다. 인공지능의 법적지위에 따라 기능, 작동 방식, 후견감독인·법원의 역할 등이 달라지기 때문이다. 둘째, 피후견인의 재산관리와 신상보호를 위해 인공지능을 활용하는 방안을 관련 법령 및 제도와 함께 검토하였다. 셋째, 피후견인의 의사를 검증·확인하기 위하여 인공지능을 활용하는 방안을 검토하였다. 관련하여 뇌-컴퓨터 인터페이스 기술발전을 살펴보았다.
Abstract
With the introduction of the guardianship system in July 2013, an institutional foundation was created to strengthen the human rights and welfare of people who consistently lack the ability to handle affairs due to mental limitations. However, in Korea, relatives who lack legal expertise are often appointed as guardians, and the appointment of guardian supervisors is also insufficient, so guardian support and supervision work is concentrated in the family court. Despite the family court's efforts, there is great concern that it will be difficult to appropriately respond to the demand for guardianship, which is expected to be increased in the future due to the rapid aging population. If Korea’s advanced information infrastructure and technology are combined with AI(Artificial Intelligence), changes and achievements in the guardianship system will occur. If we say that AI is “the implementation of human intellectual ability in a mechanical way”, AI can effectively and efficiently assist and support wards who lack the ability to handle affairs due to mental limitations. This study addressed the legal status, functions, effects and related legal issues when AI is introduced into the guardianship system. First, I reviewed the role of AI in guardianship taking into account the characteristics of the guardianship system. Technically, AI itself can play the role of a guardian or AI can be used as a means to assist the work of human guardians. The legal status of AI affects it’s function and operation and, furthermore, the role of guardianship supervisors and the family court. Next, I reviewed ways to use AI to protect wards with related laws and policies. Lastly, This study examines the use of AI to verify and confirm the ward's will. In relation to this, it is necessary to pay attention to the status and progress of brain-computer interface technology.
