Abstract
Both the Continental legal system and Anglo-American legal system understand that the insanity defense is one of the basic principles of traditional criminal law. Recently, however, there have been demands in the U.S. for the abolition of insanity defense, and some states, including Kansas, have abolished insanity defense. Since then, there have been discussions on the unconstitutionality of legislation that abolished insanity defense. Under these circumstances, the U.S. Supreme Court ruled in March 2020(Kahler v. Kansas) that the Eighth and Fourteenth Amendments of the United States Constitution did not require that states adopt the insanity defense in criminal cases. Recently, there have been calls in Korea to revise or abolish the Article 10(Persons with Mental Disorders) in the Criminal Act of Korea. Still in various forms, the amendment of Article 10 of the Criminal Act of Korea on insanity defense is being argued, and related bills have been submitted. At this point, the U.S. Supreme Court's ruling on Kahler v. Kansas is expected to give much implications on the meaning of criminal responsibility and insanity defense in criminal law. This paper examines the ruling of Kahler v. Kansas by the U.S. Supreme Court, and considers the meaning of insanity defense and criminal responsibility from a comparative legal point of view.
