Abstract
Unlike previous studies that tend to include the provisions on the deemed dividend and the provisions on the deemed income dividend in one topic rather than focusing on each independence, this paper focused on the provisions on the deemed income dividend and tried to find out what its characteristics were. The independent characteristics of the provisions on the deemed income dividend can be found in that the effects of corporate tax and the economic effects attributable to individual shareholders are contrary to those of the provisions on the deemed dividend. The tax effect of the provisions on the deemed dividend is to increase the amount of tax paid, such as income tax, and to advance some payment timing, and the economic effect attributed to individuals who are the subjects of investment in stocks consists only of these income tax effects. On the other hand, the tax effect of the provisions on the deemed income dividend is to reduce the amount of tax paid, such as corporate tax, and in terms of the economic effect attributable to individual shareholders, the tax burden is reduced to gain economic benefits. As previous studies have also raised, the provisions on the deemed dividend and the provisions on the deemed income dividend with almost the same content include parts contrary to economic substance. In the case of the provisions on the deemed dividend, there is some basis for justifying the part contrary to this economic substance. It can be recognized as a solution to the asymmetric taxation problem of dividend income and capital gains due to widespread non-taxation on capital gains. However, it is inappropriate to apply this logic to the provisions on the deemed income dividend. In other words, it is not appropriate to apply the purpose of the provisions on the deemed dividend to the provisions on the deemed income dividend with conflicting economic effects. Accordingly, it is necessary to clarify the independent purpose of the provisions on the deemed income dividend. In the discussion on the purpose of the provisions on the deemed income dividend, the issue will be whether to limit the scope to substantial taxation or expand it to justify the part contrary to the economic substance contained in the current regulations. The improvement of tax neutrality can be cited as a logic that can justify the part contrary to the economic substance included in the provisions on the deemed income dividend. Tax neutrality could be improved if the tax law's impact on an individual's decision-making on the choice of a stock investment entity could be reduced due to the part contrary to economic substance included in the provisions on the deemed income dividend. Regarding stock investment, it is questionable whether it is necessary to provide additional benefits at a time when benefits for corporate tax payments are already granted compared to other areas, and the fact that the part contrary to the economic substance included in the provisions on the deemed income dividend cannot completely eliminate the impact of the entire tax law, and since using the income tax law's dividend tax credit could be a more general way to reduce the impact of the tax law, it is not appropriate to evaluate the part contrary to the economic substance contained in the income dividend agenda as worth sacrificing the basic principle of the tax law of real taxation. In conclusion, it would be appropriate to limit the scope of the purpose of the provisions on the deemed income dividend to real taxation. Accordingly, the scope of the purpose of the provisions on the deemed income dividend is to be minimized for deeming the disposition gains from the extinction of stocks and stocks acquired by transferring capital with the same or similar economic substance as income dividends as income dividends. If the purpose of the provisions on the deemed income dividend is set in this way, it will be difficult to find a reason to hesitate to adopt the improvement measures suggested in the existing research, unlike the provisions on the deemed dividend.
