Abstract

The safeguard dispute over solar products adjudicated by the WTO Dispute Settlement Body in 2018 marked a significant turning point in the history of the multilateral system. The case United States–Safeguard Measure on Imports of Crystalline Silicon Photovoltaic Products (DS562) holds considerable legal and political significance as the only safeguard dispute in which the Panel did not find a violation of WTO law. Aiming to shed light on the broader implications for trade law and policy, this study examines the WTO dispute concerning the solar photovoltaic industry, provides a comprehensive overview of relevant anti-dumping and countervailing duty measures, and analyzes the key legal issues and findings in the United States – Solar Products case. Industrial competition in the global solar photovoltaic sector is expected to intensify in the years ahead. Against this backdrop, the historical context, legal issues, and policy implications examined in this study aim to contribute to future scholarship on trade and energy law. It also seeks to shape policy discussions on the “green transition,” emphasizing that the transition should not deepen Korea’s dependence on China’s solar industry. Instead, it should serve as a driver of sustainable growth of Korea’s energy sector.
