우리나라 예산심의의 문제점과 개선 방향 - 프랑스 제도를 중심으로 -

우리나라의 경우 예산비법률주의를 채택하고 있다. 프랑스의 경우 예산법률주의를 택하고 있기 때문에 예산심의를 할 때 객관성이 높고, 투명성이 높고, 예산을 공개하게 되어재정민주주의에 이바지하고 법치주의에 기여를 하고 국회가 통제를 실질적으로 할 수 있다. 예산 심의기간이 길수록 예산심의가 합리적임에도 불구하고 예산 심의기간이 짧고 심의과정이 형식적으로 운영되고 있는 실정이다. 정부의 예산안에 대한 검토와 법리심사가 제대로 이루어지지 않을 수 있기 때문에 각 부처의 조기심사권을 강화해야 할 것이다. 예산안이 부실하게 편성되지 않도록 각 부처별로 공청회를 개최해야 할 것이다. 우리나라의 경우 국회의 날치기 통과를 막고 예산안 심의가 지연되는 것을 막기 위해정부예산안 자동부의제도가 들어간 국회 선진화법을 제정했다. 국회가 예산안의 심사를 11 월 30일까지 마치지 못하면 12월 1일에 본회의에 자동으로 부의되기 때문에 정부예산안은12월 초에 의결·확정되는 것이다. 그러나 예산안자동상정제를 헌법이 아닌 국회법에 규정하고 있어 국회에서 이 예산안자동상정제 조항을 쉽게 폐지 할 가능성이 있다. 쉽게 폐지하지 못하도록 하기 위해서는 프랑스처럼 이 조항을 헌법에 규정해야 할 것이다. 우리나라의 경우 예산편성에 있어 정부가 국회에 예산정보를 제공하는 것이 약해 보이고 국회법에 이와 관련한 상세한 규정을 두고 있지 않다. 그러나 프랑스의 경우 재정조직법에 예산편성에 있어 의회에 예산정보를 제공하도록 명문을 두고 구체적 절차까지 규정하고 있다. 감사원은 국가가 예산을 집행한 경우 회계감사를 할 수 있다. 국회가 예산심의한 후에예산심의에 따른 문제점을 보완하기 위해서는 감사와 결산기능을 강화할 필요가 있다.
Abstract
In Korea, the elaboration of the budget is not written in law. However because the budget in France is elaborated in law, the civil servant is responsible by the Parliament and the court. If the length of the deliberation of the budget is long, the examination of the the plan of the budget and the principle of the law will reasonable. We had better strengthen the power of examination in advance about each ministry by the Parliament. We had better open the meeting for listening and for speaking about each ministry in order that the plan of the budget is not set out insufficiently. The Parliament made the developed law in Korea. If the Parliament do not make the plan of the budget until November 30, the plan of budget est determined in the beginning of December. But because this plan est set up not by the constitution but by the law, the Parliament can easily do away with this clause. The Parliament must set up this clause in the constitution like the France not in order to do away with this clause easily. In France it is written to give that information to the Parliament by the organic law concerning the financial law. We must accept this system of France. In Korea the government have to give information about the setting up of the budget to the Parliament. It is necessary to prescribe law to give information to the Parliament. We must strenthen the role of independence of the house of audit and inspection.
